Who we are. Impact Benefit Consultants (“IBC,” “we,” “us,” “our”) is an independent insurance agency that helps consumers compare and enroll in Medicare Advantage, Medicare Supplement, Medicare Part D, and Affordable Care Act (ACA) plans.

We respect your privacy and are committed to safeguarding your information in accordance with applicable federal and state laws, including Centers for Medicare & Medicaid Services (CMS/Medicare) rules, Federal Communications Commission (FCC) rules, and the Telephone Consumer Protection Act (TCPA). This Privacy Policy also contains our SMS Terms of Service.

Scope

This Policy explains what we collect, how we use and share information, your choices, and our SMS/MMS program terms. It applies to information gathered through our website, phone calls, SMS, email, forms, and other interactions with IBC.

Information we collect

We may collect:

  • Identifiers & contact information: name, email, phone number, mailing address, city, state, ZIP, county.
  • Government/benefit identifiers: Medicare ID (MBI), Medicaid number/level, Social Security Number (SSN) (only if required to complete enrollments).
  • Health/benefit information (PHI/PII): date of birth, gender, current coverage, providers (PCP/specialists), prescription drugs (name, strength mg, dosage, frequency), pharmacies, chronic conditions (as necessary to provide plan comparisons).
  • Financial/eligibility data: LIS/Extra Help status, dual-eligibility status, HRA/application confirmation numbers when applicable.
  • Communications: your messages and preferences (including SMS opt-ins/opt-outs and support requests).
  • Website/device data: pages viewed, time/date, IP address, cookies or similar tools for site functionality and analytics.

We collect data from you directly, from authorized representatives, from public sources (e.g., Medicare.gov), and—only with your authorization—from carriers, CMS, pharmacies, and other service providers necessary to provide our services.

How we use information

  • To compare plans, verify providers and prescriptions, check eligibility (e.g., LIS/Extra Help), prepare recommendations, and assist with enrollments.
  • To communicate with you (phone, email, SMS) about appointments, reminders, important plan notices, enrollment status, and—if you consent—helpful updates or offers related to Medicare and ACA plans.
  • To meet legal, regulatory, and CMS compliance obligations, including required documentation and audits.
  • To operate, secure, and improve our website and services (analytics, quality assurance, fraud prevention).

How we share information

We do not sell your personal information. We may share only as needed to provide services or comply with law:

  • With CMS/Medicare, state/federal agencies, and plan carriers (to verify benefits, providers, prescriptions, and to complete enrollments).
  • With service providers under contract (e.g., secure document/e-signature platforms, CRM, appointment tools, SMS providers) who must safeguard your information and use it only on our instructions.
  • With regulators or law enforcement when required by law.
  • As de-identified or aggregated data that cannot reasonably identify you.

Mobile/SMS consent: Mobile opt in, SMS Consent, and phone numbers collected for SMS communication purposes will not be shared with any third party or affiliates for marketing purposes.

HIPAA & safeguarding health information

We maintain administrative, technical, and physical safeguards reasonably designed to protect Protected Health Information (PHI) and Personally Identifiable Information (PII) (e.g., access controls, encryption in transit where feasible, staff training, minimum-necessary use). Where applicable, we enter Business Associate Agreements (BAAs) with vendors handling PHI.

Data retention

We retain records for the period required by CMS/Medicare and applicable state/federal law (often up to 10 years for enrollment/compliance records), and longer if needed to resolve disputes or enforce agreements. When no longer required, we securely dispose of information.

Your choices & rights

  • You may update or correct your information by contacting us.
  • You may opt out of marketing communications at any time (see SMS terms below for STOP/HELP).
  • Depending on your state, you may have rights to access, delete, or limit certain uses of your personal information; contact us to make a request. We will verify identity as required.

Cookies & tracking

We may use cookies or similar technologies for site functionality and analytics. You can adjust browser settings to limit cookies; doing so may affect site performance.

Children’s privacy

Our services are for adults (18+). We do not knowingly collect information from children under 13.

Medicare/CMS compliance disclosures

  • We are independent and not connected with or endorsed by the U.S. government or the federal Medicare program.
  • You can obtain plan information from Medicare.gov or 1-800-MEDICARE (TTY: 1-877-486-2048) and from your State Health Insurance Assistance Program (SHIP).
  • Any plan/benefit descriptions are county- and individual-specific and subject to change by carriers and CMS each year. Final eligibility and benefits are determined by the carrier/CMS.

SMS Consent Communication:

The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

Types of SMS Communications:

If you have consented to receive text messages from IMPACT BENEFIT CONSULTANTS, you may receive messages related to the following:

  • Related to plan reviews, enrollment windows (e.g., AEP/OEP/SEP), appointment reminders, document requests, prescription/provider verification, and relevant benefit updates.

Message Frequency:

Message frequency may vary depending on the type of communication.

Potential Fees for SMS Messaging:

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

Opt-In Method:

You may opt-in to receive SMS messages from IMPACT BENEFIT CONSULTANT in the following ways:

  • By submitting a website form

Opt-Out Method:

You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP” to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.

Do-Not-Call, FCC/TCPA & CTIA compliance

We honor federal and state Do-Not-Call rules and maintain internal suppression lists. We send autodialed/automated or prerecorded marketing calls/texts only with express written consent. We follow CTIA guidelines for message content, opt-out, and program naming.

Security

We employ reasonable safeguards (access controls, need-to-know, encryption in transit where feasible, vendor due diligence, staff training). No method is 100% secure; please contact us immediately if you believe your information has been compromised.

Changes to this Policy

We may update this Policy from time to time. We will post the new effective date at the top and, where required, provide additional notice.

By using our website and services, you agree to:

  2. No guarantees: We strive for accuracy, but plan availability, benefits, networks, and costs are controlled by carriers and CMS and may change. Final eligibility/benefits are determined by carriers/CMS.
  3. No government affiliation: IBC is independent and not affiliated with or endorsed by the U.S. government or the federal Medicare program.
  4. Intellectual property: Site content is owned by IBC or its licensors. You may not copy, scrape, or reuse material except for personal, noncommercial use related to getting insurance help.
  5. Communications: By providing contact information, you permit us to contact you about your inquiry. SMS/robocalls for marketing are only sent with your express written consent (see SMS Terms). You may opt out anytime.
  6. Disclaimers & liability limits: To the fullest extent permitted by law, IBC is not liable for indirect or consequential damages arising from your use of our website/services.
  7. Governing law: This Policy and Terms are governed by applicable U.S. federal law and the laws of the state in which IBC operates.
  8. Dispute resolution: Please contact us first to resolve concerns. If unresolved, disputes may be handled through a mutually agreed forum consistent with applicable law.
  9. Updates: We may modify these Terms; continued use after changes constitutes acceptance.
